Tesla Driver Killed in Florida Crash Ignored His Vehicle’s Warnings

Both the NTSB and NHTSA did not find any fault with Tesla’s autopilot system in a May 2016 crash in Florida that grabbed national attention.

Broward, FL- The American public Is distrustful of self-driving cars and a widely publicized fatal crash that occurred in May 2016 didn’t help ease fears of autonomous vehicles. Initially, the cause of the accident appeared to be the fault of his Tesla’s autopilot feature, but a National Traffic Safety Board (NTSB) investigation found that the driver ignored his vehicle’s warnings.

NTSB Findings for Tesla Crash in Florida

Last May, an Ohio man was driving his newly acquired Tesla in Florida when he took a left turn into the path of a tractor-trailer. The man was using the auto-pilot feature on his vehicle when the turn was made and the impact occurred. The driver was killed.

Because the accident involved an emerging technology, the NTSB, and the National Highway Traffic Safety Administration investigated.

The NTSB report did not identify a cause of the accident but they did find that the driver ignored warnings to keep his hands on the wheel. The NTSB also found that the driver made no attempt to turn the wheel, brake or before the crash and was traveling 74 mph in a 65-mph zone.

Both the NTSB and NHTSA did not find any fault with Tesla’s autopilot system in a May 2016 crash in Florida that grabbed national attention.

“Autopilot is by far the most advanced driver-assistance system on the road, but it does not turn a Tesla into an autonomous vehicle and does not allow the driver to abdicate responsibility,” a spokesperson for the company said in June 2016 after the crash occurred. Tesla has not issued a statement regarding the NTSB’s findings.

According to USA Today, the NHTSA, who conducted a separate investigation, did not find any problems with Tesla’s self-driving system. Furthermore, the agency found that the Tesla driver should have seen the semi-truck coming seven seconds before the accident and attributed the crash to an “extended period of distraction,” USA Today reports.

Self-driving Autos and Accidents

Self-driving or autonomous cars and commercial trucks are the waves of the future, but they aren’t yet common yet, so there are issues that haven’t been tackled and won’t be for a long time. But when self-driving cars become common, there may be fewer traffic accidents, but there will still be accidents, and they will probably involve multiple self-driving cars. When that happens liability for these crashes will become an issue that will need to be tackled by the courts and personal injury attorneys.

The question of liability is a hurdle all accident victims encounter; they can overcome those hurdles by hiring a personal injury lawyer in Broward, Florida.

Overcome Liability Issues with an Accident Attorney in Broward

Most accidents in Florida don’t involve autonomous vehicles. Nevertheless, liability can be any problem for any accident victim. Cause and fault are cut and dry in some accidents, but they are not obvious in all cases. If you must overcome any issues with liability, you should retain an accident lawyer in Broward, Florida to investigate, gather evidence, negotiate with insurers, and, if necessary, build a civil claim on your behalf. USAttorneys.com can refer you to a local lawyer you can meet with and discuss how you can resolve your case with best results.

Recent traffic data analysis from AAA found that drowsy driving is responsible for an estimated one on five traffic accidents.

Syracuse, NY- In 2015, the Centers for Disease Control identified sleep deprivation as a national health crisis and problem hasn’t gotten any better. How Common Are Spinal Cord Injuries in Traffic Accidents?

The leading cause of spinal cord injuries is traffic accidents.

San Diego, CA- Car crashes typically involve a lot of force that can be very damaging to the human body. Far too many car accident victims suffer devastating injuries that are life-changing including a spinal cord injury.

Anatomy of a Spinal Cord Injury

The National Institutes of Health says that a spinal cord injury is the result of a traumatic blow to the spine that can cause “bone fragments, disc material, or ligaments bruise or tear into spinal cord tissue.” Sometimes the impact of a crash can severe a vehicle occupant’s spine resulting in full or partial paralysis. The AANS notes that the close to the neck a spinal cord injury is, the greater chance an accident victim has of becoming paralyzed.

Types of Permanent Spinal Cord Injuries include:

Paraplegia- This results from a spinal cord injury in the thoracic or lumbar regions leaving a victim unable to control their legs or lower regions of their body.

Tetraplegia- This is also known as quadriplegia. It is a spinal cord injury that occurs in the neck region and results in a victim’s inability to control all four limbs.

Complete Spinal Cord Injury- A victim who suffers a complete spinal cord injury experiences a complete loss of motor control or sense below the region

Incomplete Spinal Cord Injury- An incomplete spinal cord injury occurs when a victim has motor control and sensations in half of their body.

The leading cause of spinal cord injuries is traffic accidents.

Leading Causes of Spinal Cord Injuries

The American Associates of Neurological Surgeons (AANS) estimates that 450,000 Americans live with a spinal cord injury each year. What are the leading causes of spinal cord injuries?

Traffic accidents cause 39.08% of spinal cord injuries each year in the U.S. Below is a list of vehicle type and percentage of spinal cord injuries:

Cars, buses, SUVs, trucks- 26.91 percent

Motorcycles- 6.8 percent

Bicycles-2.78 percent

ATVs- 1.37 percent

When Can a Pedestrian File a Personal Injury Claim?

Pedestrian accidents are common in New York City as the streets are constantly filled with anxious tourists, rushing residents, and a constant flow of traffic.

Accident lawyers in New York City are available to help anyone who has been injured in any type of accident.

Walking down the streets of New York City is a far more common method of travel as opposed to operating a vehicle. The city attracts tourists, citizens from neighboring cities and states, and residents which is makes it one of the busiest cities to live in or visit. It is expected to encounter immense buildings towering overhead, large crowds of people, cars, bicyclists, pedestrians, vendors, and much more while traveling up any of the city’s streets. However, one thing that isn’t a common occurrence is seeing a pedestrian being knocked to the ground by a hammock.  Unfortunately, one woman who was visiting from the United Kingdom experienced this as she was walking past a Tribeca building.

Tourist Visiting NYC Hit by Falling Hammock

According to CBS New York, the 48-year-old woman was touring New York City with her husband when the incident transpired. The two were walking down Park Place near Church Street. Apparently, a hammock with a wooden base fell 50 feet from a TriBeCa House residential building. The rainy and windy weather is said to have been the cause of the hammock falling. The woman did suffer from some pretty serious injuries and was transported to NYC Health Hospitals/Bellevue.

While the Department of Buildings wasn’t needed for help regarding this accident, it was highlighted that it could have been prevented. This is an indicator for a New York City accident attorney that negligence may have been a factor and hence, would suffice as a viable accident claim.

It was also highlighted that the department generally receives alerts from the Office of Emergency Management and the National Weather Service when winds reach a speed of 30 mph or higher. They weren’t informed during the time of this incident and the winds reportedly weren’t moving at a 30-mph rate. However, it is hard to decipher how strong winds really are as the big buildings almost have a tunneling effect which increases the wind speeds. The Department of Buildings is also responsible for making sure all tenants comply when given a wind warning and asked to remove any mobile objects that could be lifted into the air. And if they don’t, they could face a fine of up to $10,00 to $25,000.

What are Some Common Types of Pedestrian-Related Accidents?

New York City is prone to having accidents occur as there is a significant amount of traffic going in and out of the city both in vehicles and on foot. Some of the common types of pedestrian accidents that occur include:

  • Back over accidents

Why is the Darkness a Dangerous Time for Drivers?

It is said that as we age, our vision tends to suffer as do many of our other capabilities. While it is true that many adults have a more difficult time seeing at night, nighttime itself can be a rather dangerous time to be out on the roadway. There are many factors that contribute to accidents, nighttime driving included as one. Based on research conducted by the National Safety Council (NSC), “the risk of a fatal crash is three times greater at night.” Of course, there are times when we simply cannot avoid driving at night so it is important to be cognizant of the ways you can avoid these hazards that lurk on the roadways when the sun is “sleeping.”

Did you recently engage in an accident? Were you a driver or a pedestrian? Are you currently suffering with any injuries? If so, you need to speak with a licensed and skilled Syracuse, New York accident lawyer in your area who can provide you with some important information regarding your accident and what you might be entitled to receive.

How Can I Decrease my Chances of Engaging in a Nighttime Accident?

Nighttime driving increases your chances of engaging in an accident as the bright and blurry lights make is much harder to see.

When driving at night, there are three things that are comprised:

  1. Depth perception
  2. Color recognition
  3. Peripheral vision

Have you ever driven at night and thought you were approaching a lit up building ahead only to get closer and realize it was a semi-truck? The fact is, with all the blinding lights and glare that come from many of the other lights that are present on the roadway, you aren’t able to see as clearly as you would like. Your “visibility is limited to about 500 feet (250 feet for normal headlights) creating less time to react to something in the road, especially when driving at higher speeds.”

Some of the ways the NSC suggests you can combat the darkness is by:

  • Aiming your headlights correctly.
  • Make sure they are clean.
  • Looking away from oncoming lights.
  • Wear anti-reflective glasses if you are required to wear any.
  • Clear your windshield to eliminate any streaks.
  • Drive at a slower speed to help compensate for the limited visibility and reduced stopping time.

Is Your Night Vision Being Compromised?

As mentioned, age not only brings along with it experience, but a decrease in our visibility. According to the American Optometry Association, “a 50-year old driver may need twice as much light to see well as a 30-year old.” Many older drivers who are operating their vehicles at night have comprised vision as some have cataracts and others have degenerative eye diseases. This makes for driving at night even more riskier than it would be for the average individual. So, if you are an elderly driver, don’t forget to have your annual vision exams, minimize your distractions, and make every attempt to limit your driving to only doing so during the day.

In the event you have already become the victim to a life-threatening injury caused by an accident on the roadway, let USAttorneys.com find you the best accident attorney in Syracuse, NY who can ensure the compensation you need and deserve is the compensation you are provided with.
